KB then implemented its typical bait and switch tactic by discontinuing the initial home collection, and introducing a cheaper collection at the expense of the initial homeowners’ equity. There were many homeowners in the construction process of their home, or considering purchasing an inventory home and KB FAILED to disclose this significant information. KB’s actions denied these homebuyers the opportunity to make an education choice because KB purposely withheld this information. Many homeowners have suffered 10%-20% devaluation of their equity in less than a year because of the actions of KB Home, despite the strong market performance of their area increasing ~2.2%. Drainage has been a concern among many residents in the community. Approximately, in 2007-early 2008 when San Antonio received a heavy rainfall, this community suffered the wash out of paved roads. Secondly, there has been on ongoing debate between residents and KB Home about the flood plain. There are numerous flood plain maps that have been produced regarding this community, and some maps show up to 20-30 homes in an active flood plain. More tragic is the KB construction standard that plagues many home owners in this neighborhood. Numerous home owners have suffered major structural defects within the first year of their ownership. Even if KB is able to fix these defects, it will remain challenging for the home owner to re-sell their home when this is disclosed to the potential home buyer. 13231 Sunset Rainbow – San Antonio, TX This home was purchased by Blake and Jennifer from KB Home on November 16, 2006 in the Sundance Trails subdivision in San Antonio, TX. Unfortunately, this is one of the homes built to the KB standard of construction that is currently applied to all homes throughout San Antonio. These homeowners suffered numerous structural defects, including a defective foundation. Less than two years after purchasing this home and battling KB, the homeowners won a victory by selling the home back to KB on August 27, 2008. When KB re-sells this home in the future, they are not held to the same standards of disclosure that a home owner is in terms of disclosure. Approximately one year after purchasing this home and battling KB, the homeowners won a victory by selling the home back to KB on September 2, 2008. When KB re-sells this home in the future, they are not held to the same standards of disclosure that a home owner is in terms of disclosure. You can see on the MLS listing that there is no mention of previous structural defects, or why KB bought back this house.
